Voting Official Rules
NO PURCHASE OR USE OF WIRELESS SERVICE IS NECESSARY TO ENTER OR WIN. Entrants do not
have to purchase any products to vote.
This Voting is open to legal residents of the following U.S. states: AZ, CA, CO, CT, FL, GA, IA, MN, MO, NC, ND, NV, OK, PA, TN, TX, and D.C., and who are
13 years of age or older as of May 14, 2008. Void in all other states and where prohibited or otherwise restricted by law. Subject to all federal, state and
local laws. By entering the Voting, entrants are bound by and agree to these official rules.
The “The Chopper Challenge” Voting (the “Voting”) begins May 14, 2008 and ends on August 1, 2008 (“Promotion Period”).
1. Voting Description: During the Promotion Period, entrants will be asked to vote for their favorite builder. Entrants will be able to vote for their favorite builder via text message or on the web the entire length of the season, or 9 weeks, etc. On the 10th episode we crown our winner and most popular builder.
2. How To Enter: To enter vote, entrants must do one of the following:
A. Via Text: Send a text message with the keyword of RANK to 81676. You must have a text messaging two-way capable handset and digital service in order to enter the Voting using the text messaging method. You will be charged for the text messages sent and received from your handset according to the terms in your Wireless Calling Plan plus a premium text messaging charge of $0.99 each. Standard text and data rates may apply. Text Messaging and wireless service are not available in all areas. Sponsor reserves the right in its sole discretion to disqualify any text message entry at any time that, in Sponsor’s opinion, does not comply with these Official Rules. If you are a minor under the law of your jurisdiction of residence, you must have permission of your parent or guardian to enter the Voting using the text messaging method.
B. Enter for free via website: If you wish to enter for free without sending a text message during the Promotion Period, visit www.thechopperchallenge.com. You will be asked to provide basic contact information, including your name, age, email, or mobile telephone number (“MTN”).
All entries become the sole property of The Chopper Challenge, Inc. Incomplete entries are void. Any individual who attempts or otherwise encourages, directly or indirectly, the entry of multiple or false contact information under multiple identities, by cellular phone, or uses any device or artifice to enter or encourage, directly or indirectly, multiple or false entries will be disqualified. The Chopper Challenge and CW Multimedia and their respective parents, subsidiaries and affiliates are not responsible for late, lost, delayed, unclear, unintelligible, incomplete, misdirected or ineligible entries which will be disqualified or for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the sender, or by any of the equipment or programming associated with or utilized in the Voting which may limit the ability to play or participate, or by any human error that may occur in the processing of the entries in the Voting.
If for any reason, including tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond reasonable control of The Chopper Challenge LLC and CW Multimedia and their respective parents, subsidiaries and affiliates, that corrupts or affects the administration, security, fairness, integrity, or proper conduct of each Voting, and the Voting is not capable of being conducted as described in these Official Rules, The Chopper Challenge LLC and CW Multimedia shall have the right, at their sole discretion, to cancel, terminate, modify or suspend this Voting, and select the winner from entries received prior to action taken, or as otherwise deemed fair and appropriate. Sponsor reserves the right to prosecute any fraudulent entries to the fullest extent of the law.
3. Notification: A winning builder will be selected on the tenth (10) episode from all eligible entries received for the Voting. The Chopper Challenge reserves the right to adjust the voting to compensate for the time periods to ensure a fair and reasonable time period of voting for each builder. Tabulation of the votes will be conducted by The Chopper Challenge, LLC., whose decisions shall be final and binding, as the administrator of this Voting. The winner will be notified by phone, email, or text message.
4. Eligibility: Voting is open to legal residents of the following U.S. states: AZ, CA, CO, CT, FL, GA, IA, MN, MO, NC, ND, NV, OK, PA, TN, TX, and D.C., and who are13 years of age or older as of as of May 14, 2008. Individuals employed by The Chopper Challenge LLC and CW Multimedia or any of their respective parent and affiliated companies, subsidiaries, advertising and promotional agencies and any and all other companies associated with the Voting and their immediate families (parent, siblings, children and spouse) and persons residing in the same household (whether related or not) of such employees are not eligible to vote.
5. General: By voting, all entrants agree to be bound by these Official Rules and by the decisions of, The Chopper Challenge LLC and CW Multimedia, which shall be final and binding. The Chopper Challenge LLC and CW Multimedia may prohibit any entrant or potential entrant from participating in the Promotion, if at the sole discretion of The Chopper Challenge LLC and CW Multimedia, such person shows a disregard for these Official Rules, or acts (1) with an intent to annoy, abuse, threaten, or harass any other entrant, The Chopper Challenge LLC and CW Multimedia, or their agents or representative; or (2) in any other disruptive manner. By participating in the Voting by text message, all entrants will allow CW Multimedia to communicate with them on behalf of The Chopper Challenge, Inc. Entrants who do not comply with these Official Rules or attempt to interfere with this Voting in any way shall be disqualified. The use of automated entry devices or any other conduct that impedes the integrity of the Voting is prohibited. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Sponsors in connection with the Promotion, shall be governed by and construed in accordance with the laws of the state of California without giving effect to any choice of law or conflict of law rules or provisions which would cause the application of the laws of any jurisdiction other than the State of California. Sponsors’ decisions as to all matters related to the administration of the Promotion and selection of the prize winners are final.
6. Indemnification: By voting, all entrants agree to be bound by these Official Rules and the decisions of The Chopper Challenge LLC and CW Multimedia. By voting, entrant agrees to release, defend, hold harmless and indemnify The Chopper Challenge, Inc., CW Multimedia, Country Music Television Inc., CMT Productions Inc., MTV Networks, Viacom International, Inc. and their respective parents, subsidiaries, affiliates, contractors, sponsors, directors, officers, governors, employees and agents against any and all liability, damages or causes of action (however named or described), with respect to or arising out of either (i) any damage to entrant's cellular telephone relating to or resulting from entering this Promotion; or (ii) any injuries, losses, or damages of any kind caused by the acceptance, possession, use or misuse of a prize awarded in the promotion, including but not limited to any claims for damage to property, personal injury, death or claims based on defamation, rights of privacy, rights of publicity. False or deceptive entries or acts will render the entrant ineligible. The Chopper Challenge LLC and CW Multimedia are not responsible for any printing or typographical errors in these Official Rules or any other materials associated with the Promotion. Entrants enter at their own risk and Country Music Television Inc., CMT Productions Inc., MTV Networks, Viacom International, Inc., The Chopper Challenge LLC and CW Multimedia are not responsible for and shall not be liable for any condition caused by events beyond their control that may cause the Promotion to be disrupted or corrupted.
8. Arbitration and Choice of Law: Except where prohibited by law, as a condition of participating in this Voting, entrant and Sponsor agree that (1) any and all disputes and causes of action arising out of or connected with this Voting, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the contestant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than entrant's actual out-of-pocket expenses (i.e., costs associated with entering this Voting), and entrant further waives all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of contestants and Sponsor in connection with this Voting, shall be governed by, and construed in accordance with, the substantive laws of the State of California without regard to California’s choice of law rules.
